Wrongful death suit heads to trial

ST. GEORGE— Attorneys representing the plaintiff and defendants in a wrongful death suit met in 5th District Court on Monday to discuss pretrial matters before the case stemming from a 2007 incident is set to culminate in a two-week jury trial in September.

David Livings, 54, of St. George, was killed in a motorcycle accident in October 2007 while riding on River Road near the Tamarisk Drive intersection. He was struck by a runaway trailer owned by a construction company.

During the incident, Sykes was driving a Dodge Ram truck southbound on River Road and Livings was traveling northbound when the trailer detached from the truck, crossed the center line and struck the motorcycle, according to the wrongful death complaint.

He suffered multiple injuries, including a shattered pelvis and injuries to his leg and head, which resulted in his death, according to police. The police also said Livings was not wearing a helmet at the time of the incident.

The Livings family has filed a wrongful death suit against defendants A-T Asphalt Paving Inc., Tri-West Construction and Development Inc., Jason L. Sykes, Kent Wallis, Does 1-50, Cincinnati Insurance Company, A-T Trucking LLC and Cottam Revocable Trust.

According to the complaint made by the plaintiff, the trailer that struck Livings is owned by Cottam, Tri-West and A-T Asphalt.

On Monday, attorneys discussed the upcoming trial, which could take up to two weeks and include a jury pool of 80 jurors to choose from.

The involved parties have attempted to mediate and settle the case outside of a trial, but it appears no terms have been agreed upon. A trial date is set for Sept. 20 in 5th District Court.
